1. Service Description
LigaTech, Inc. AI Chatbot ("Service") is a SaaS (Software as a Service) platform that enables businesses to provide AI-powered automated customer service through WhatsApp, Instagram, Facebook Messenger, and websites.
2. Account Creation and Security
- You must create a valid account to use the Service.
- You are responsible for the accuracy and currency of your account information.
- You are responsible for maintaining the security of your account and preventing unauthorized access.
- You are responsible for all activities that occur under your account.
- You must notify us immediately if you notice any unauthorized access to your account.
3. Acceptable Use
By using the Service, you agree to comply with the following rules:
- You will comply with all applicable laws and regulations.
- You will not use the Service for illegal, harmful, or fraudulent purposes.
- You will not send spam, unsolicited messages, or misleading content.
- You will not violate the rights of other users.
- You will not engage in activities that compromise the security of the Service.
- You will comply with the terms of use of third-party platforms (Meta, WhatsApp, etc.).
4. Subscriptions and Payments
- The Service offers subscription plans with different features.
- Subscription fees are billed monthly or annually based on the selected plan.
- Price changes will be communicated at least 30 days in advance.
- Payments are securely processed through the Stripe payment infrastructure.
- Your account may be suspended in case of failed payments.
5. Cancellation and Refund
- You may cancel your subscription at any time.
- After cancellation, you will continue to have access to the Service until the end of the current billing period.
- Prorated refunds for unused periods are not provided (unless otherwise stated).
- You may request a full refund within 14 days if you are not satisfied (for the initial subscription).
6. Intellectual Property
The Service and all associated content (software, design, logos, text) are the intellectual property of LigaTech, Inc.. You are granted a limited, revocable, non-transferable license solely to use the Service.
The content and data you create for your chatbot belong to you. However, you grant us permission to process this data in order to provide the Service.
7. Service Level
- We aim for a 99.9% uptime availability.
- Scheduled maintenance will be announced in advance.
- Notifications will be provided for unexpected outages.
- We are not responsible for outages on third-party platforms.
8. Limitation of Liability
The Service is provided "as is". To the maximum extent permitted by law:
- We are not liable for indirect, incidental, or special damages.
- Our total liability is limited to the fees paid in the last 12 months.
- We do not guarantee the accuracy of AI-generated responses.
- We are not responsible for interruptions in third-party services.
9. Account Suspension and Termination
We may suspend or terminate your account in the following cases:
- Violation of these terms
- Non-payment
- Illegal activities
- Violation of third-party platform rules
- Abuse of the Service
10. Changes
We may update these terms from time to time. Significant changes will be communicated at least 30 days in advance. Your continued use of the Service after changes constitutes acceptance of the new terms.
11. Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, USA, without regard to its conflict of law provisions. Any dispute arising out of or relating to these Terms or the Service shall be subject to the exclusive jurisdiction of the state and federal courts located in New Castle County, Delaware. You also agree to comply with all applicable U.S. federal laws including the CAN-SPAM Act, TCPA, COPPA, and DMCA where relevant. Customers in the EU/UK retain their statutory rights under applicable consumer protection and data protection laws (including GDPR).
12. Copyright Policy (DMCA)
We respect intellectual property rights and respond to clear notices of alleged copyright infringement under the Digital Millennium Copyright Act (DMCA), 17 U.S.C. § 512.
To file a DMCA notice of claimed infringement, send a written notification to our designated agent at dmca@1click.chat including:
- Identification of the copyrighted work claimed to have been infringed;
- Identification of the allegedly infringing material and information sufficient to locate it on the Service;
- Your contact information (name, address, telephone, email);
- A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law;
- A statement, made under penalty of perjury, that the information in the notice is accurate and that you are authorized to act on behalf of the copyright owner;
- A physical or electronic signature of the copyright owner or authorized representative.
In accordance with the DMCA and our repeat infringer policy, we may terminate accounts of users who are determined to be repeat infringers.
